WMD charges added against men accused of plotting to kidnap MI governor

Three men charged in the plot to kidnap Governor Whitmer now face weapons of mass destruction charges. The US Attorney's Office that filed the charges accuses the three of aiming to use the devices for "harming and hindering the governor's security detail and any responding law enforcement officers" amid the plot to kidnap Whitmer.

A federal grand jury returned the indictment with additional charges Wednesday.

Croft and Harris were also hit with a new count of possessing a destructive device.

Fox, Croft and Harris along with Brandon Caserta, Ty Garbin and Kaleb Franks were arrested and charged in October with conspiring to grab Whitmer, a Democrat, from her vacation home in Antrim County, a rural area in northern MI. Harris is alleged to have possessed, between July 10, 2020 and September 13, 2020, an Anderson Manufacturing, Model AM-15, .223/5.56 mm caliber semiautomatic assault rifle with a barrel of less than 16 inches in length, that was not registered to him.

Fox, Croft, and Harris - along with defendants Kaleb Franks and Brandon Caserta - already face life in prison if convicted in the kidnapping conspiracy, the release said, adding that "Fox, Croft, and Harris each face up to life in prison if convicted of conspiracy to use a weapon of mass destruction".

The crew had surveilled the governor's home and conducted field training exercises to practice "combat tactics, including assaulting motor vehicles using semiautomatic assault rifles and live ammunition", to prepare for the ambush, the indictment alleges.

That same day, Fox ordered $4,000 worth of explosives from an undercover Federal Bureau of Investigation agent, whom Fox, Harris, Frank and Garbin met in Ypsilanti, Mich., on October 7 to put down a payment toward the explosives and other supplies, according to the indictment. Garbin faces up to life in prison for his conviction and awaits sentencing.

Fox and Croft, both members of the Three Percenters militia group, were angry over coronavirus restrictions imposed by Whitmer, and prosecutors said the recruited "like-minded individuals" to their plot to kidnap her in retaltiation.
