Rape Charges Against Reality TV Doctor And Girlfriend To Be Dropped

Then-district attorney, Tony Rackauckas, accused the pair of working as a team to lure women they met at nightspots, drugging and/or supplying them with large amounts of alcohol then taking them to Robicheaux's home, where the victims were assaulted.

But the Orange County District Attorney's Office on Tuesday said there isn't evidence to prove such a case against them. During his election campaign, Spitzer accused Rackauckas of improperly handling the case and using it to draw publicity.

On Tuesday, Spitzer said that after having attorneys in his office review extensive evidence including audio and video recordings, text messages and documents, he chose to ask the court to dismiss the case.

"I just feel bad for the women who had the courage to come forward and give their evidence to the authorities in this case", his statement said.

Mr Spitzer said the case was "manufactured".

Robicheaux was arrested in September 2018 after investigators allegedly found videos on his phone which appeared to show numerous women intoxicated by anesthesia or other means, "beyond the ability to consent or resist" and "barely responsive" to his sexual advances.

The comments drew widespread media attention.

The couple was charged with 17 counts each, with Robicheaux being charged in connection with seven victims and Riley in connection to five.

Defense lawyers challenged the existence of videos showing sexual assault.

"There is not a single piece of evidence, not a single video or photo, that shows how an unconscious or disabled woman is sexually assaulted". Spitzer disputed that claim today during a news conference.

"There's nothing more hard to now explain to victims that because of governmental overreaching they were used to enhance the facts of the case", Spitzer said.

A message has been sent to Rackauckas' law office seeking comment. But the state determined there was no issue and the county should proceed.

"This office will go to court as soon as possible and seek a dismissal on all the charges against the defendants", he said.

Spitzer said he has referred Rackauckas' handling of the case to the State Bar for review and has opened an internal personnel investigation.

The district attorney said he will meet with the alleged victims to explain to them why the review did not sustain the burden of proof.

Philip Cohen, an attorney for Robicheaux, said the doctor's life was ruined and his career will never be repaired.

"I don't want to be overly dramatic or hyperbolic, but the mere filing of this case has irreparably destroyed two lives", he said. He said his client would be devastated if the case was dismissed because, she maintains, she was sexually assaulted.
