Guess Chairman Paul Marciano resigns after probe into improper conduct

Guess Inc. says its co-founder Paul Marciano is stepping down after a company-commissioned investigation of allegations of sexual harassment and assault.

"The investigation found that on certain occasions Mr. Marciano exercised poor judgment in his communications with models and photographers and in placing himself in situations in which plausible allegations of improper conduct could, and did, arise", the company said.

Although he forfeited his salary for the period from February 20, when the investigation was first announced, until he notified the board of his resignation on Monday, the outgoing Marciano will collect a salary from now until January, Guess said in a filing.

The fashion retailer said on Tuesday that numerous allegations, which included inappropriate comments and texts and unwanted advances, could not be corroborated.

The allegations against Paul Marciano, who remains as chief creative officer of Guess, first emerged in February when United States model Kate Upton tweeted that it was "disappointing" Guess was still "empowering" him as its creative director.

An internal document obtained by the website said that, although numerous allegations couldn't be corroborated, there was evidence that "Mr. Marciano exercised poor judgment in his communications with models and photographers and in placing himself in situations in which plausible allegations of improper conduct could, and did, arise". He denied the allegations but, two weeks after they were leveled, Marciano stepped down from his day-to-day duties. The brothers co-founded the brand in 1981.

"Many of the allegations could not be corroborated".

Supermodel Upton recently took to Instagram to slam Guess chiefs for attempting to pull off a "stunt" in their sexual misconduct investigation into her allegations against Marciano.

Paul Marciano handled the company's advertising, best known for its black-and-white photos of models including Anna Nicole Smith.

US-based Guess and Paul Marciano will pay $500,000 to five individuals.
