Vikas Barala gets bail in Chandigarh stalking case

Barala and his friend Ashish Kumar, who remains in judicial custody and is yet to move the HC for bail, were arrested on August 9 previous year. They were arrested after the girl filed a police complaint against them.

Vikas Barala and Ashish Kumar were arrested on August 9, 2017 after Varnika Kundu from Chandigarh narrated the harrowing experience she suffered by the duo on the night of August 4. "If this can happen in Chandigarh, it can happen anywhere", she earlier wrote in a Facebook post.

In December, Barala's counsel, seeking regular bail from the court, submitted his client had been behind bars for almost four months.

The high court had last month directed the district court to complete the cross-examination of Kundu before January 11 when it had listed the bail plea for consideration. She also stood by her allegations and reiterated the entire sequence of events in the court, according to another report in The Indian Express. The court was also informed that cross-examination of the woman was over and in no manner could the accused influence the trial.

Today, Vikas was granted bail.

His counsel had sought a regular bail last month from the high court, submitting his client had been behind bars for four months.

After hearing both the parties, the court accepted the arguments of accused's counsel and granted bail with some conditions. "We have full faith in the functioning of our judicial system".

His petition for bail was dismissed four times by the trial court.

Later, the police added two more sections for attempted kidnapping. For attracting section 354D, it is necessary that a man follows a woman and contacts or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman.
