Killer Of Fox Executive Gavin Smith Gets Max Sentence

A convicted drug dealer was sentenced Tuesday in California to 11 years in prison in the beating death of a movie studio executive who had been having an affair with his wife.

Smith was last seen on May 1, 2012, with Creech's estranged wife Chandrika Cade at a park in Smith's vehicle.

A downtown Los Angeles jury rejected prosecution arguments that Creech murdered Gavin Smith after catching him in a romantic tryst with Creech's wife, but the panel in July convicted him instead of voluntary manslaughter.

Marcus called Creech "a cold person" for killing Smith and then concealing the body, according to video of the hearing aired on CBS Los Angeles. Cade had reportedly first met Smith at a drug rehab center in 2008. Creech beat Smith while Creech's wife pleaded with him to stop, according to prosecutors.

Almost a year after his disappearance, the former Fox executive's vehicle was found at a Simi Valley storage facility that was connected to Creech. At the trial, Deputy Public Defender Irene Nuñez told jurors Creech had acted in self-defense after Smith choked Creech and gouged his eyes before threatening him with a hammer-like tool. Creech would take the body and bury it in a shallow grave in the Angeles National Forest in the Antelope Valley.

Creech was already serving an eight-year prison sentence for the sale of a controlled substance when he was charged in the slaying.
